Associate Counsel

Based in Forestville, MD

 

With over 15,000 members and retirees, ATU Local 689 is the recognized voice for transit workers in and around the nation's capital. We represent public and private sector transit workers at over a dozen different employers.

Leadership seeks to bring on additional legal support to work with the General Counsel to help our organization meet the growing needs of our expanded membership and staff. This position offers the right person an outstanding opportunity to play a strong role in a dynamic organization.

This position is based at our union headquarters located in Forestville, MD, just outside of Washington, D.C. | Shift: Monday – Friday, 8:30AM – 5:00PM

Essential Duties, Responsibilities & Typical Activities
Under the supervision and direction of the General Counsel, the position will:

  • Handle a large legal caseload of substantial complexity, including grievances, arbitrations, NLRB charges and petitions, State & Federal lawsuits, and more.
  • Investigate each case and prepare the case for hearing/trial by interviewing potential witnesses, preparing subpoenas, compiling and analyzing contracts, financial records, statistical information, bargaining history and other documentary evidence.
  • Write briefs and other legal documents containing analysis of facts, legal and arbitral precedent, legal principles and argument.
  • Conduct arbitration hearings, trials and other hearings on behalf of the union and our members, including oral presentation of the case.
  • Negotiate settlement of disputes when possible.
  • Conduct bargaining history and legal research related to cases and potential cases. Analyzing current contracts in preparation for negotiations, costing out contracts, developing proposals, and bargaining with employers.
  • Work with union staff and bargaining committee members to solicit member feedback.
  • Plan and conduct legal training for members, leaders, and staff on a variety of legal issues that affect members and the organization.
  • Engage in NLRB Case Handling Activities, including Unfair Labor Practices, Impasses and Strikes, and Representation Elections. Provide legal expertise in support of union initiatives, campaigns, organizing, negotiations, and contract enforcement.
  • Assist with internal union governance matters as directed. Ensure compliance with regulatory mandates, including Beck notifications, LM obligations and 990 reports, LMRDA requirements, lobbying reporting and registration laws, other requirements concerning electoral work and campaign finance issues. Review all contracts with vendors, insurance contracts, and review real estate issues.
  • Other duties as assigned.

Qualification & Requirements

  • Demonstrated commitment to and understanding of the labor movement.
  • Ability to carry out multiple large projects simultaneously with limited supervision in line with pre-established union policies and interests.
  • Ability to communicate and collaborate with colleagues effectively. Excellent written and verbal communications.
  • Ability to use common modern word processing, calendar, spreadsheet, legal research, and presentation softwares.
  • Fast learner with an ability to adapt to new situations.
  • Ability to seek out and recommend innovative ways to tackle work problems.
  • Willingness to work extended hours as needed to complete projects and support other union activities as requested.
  • Ability to travel throughout the Washington Metropolitan region.

Suggested Education & Experience

  • J.D. from an accredited institution
  • 0-2 Years of Legal Work Experience
  • Bar membership in one of DC, MD, or VA (DC & VA preferred).

Wages & Benefits

  • Salary will be between $80,000 and $110,000 per year based on experience.
